A 26-YEAR-OLD man smiled to magistrates as he was charged with the murder of a delivery driver.

James Brabbs was appearing at Northallerton Magistrates Court for a preliminary hearing over the killing of Mohammed Saleem Khan, 37, on Sunday.

Mr Khan was found behind the wheel of a van in Long Street, Easingwold, and died after being treated at York Hospital.

Brabbs, who was raised in the Easingwold area, wore a tracksuit for the hearing.

He spoke only to confirm his name, that he understood the charge and that he did not have a home.

No friends or relatives of either Mr Khan or Brabb's attended the hearing.

Presiding magistrate Howard Charles told Brabb's the case would be transferred to Teesside Crown Court for a hearing tomorrow.

Julian Tanikal, defending, said he was considering applying for bail at the hearing.
