Councillors in Darlington are to discuss the use of new powers to curb anti-social tenants.
At present, all council tenants in the borough have a secure tenancy agreement or, if it is their first tenancy with the authority, an introductory tenancy.
This means longer-term tenants who cause a nuisance to neighbours and the community still enjoy the same benefits as good tenants.
However, under new legislation, councils can apply to the courts to take action if a tenant, or someone at their home, causes a nuisance.
Darlington Borough Council is considering proposals to adopt these Demoted Tenancy Agreements.
Under the Anti-Social Behaviour Act 2003, magistrates can make a Demotion Order if a tenant, another resident, or a visitor to the tenant's home, has behaved or threatened to behave in a way that would cause annoyance or nuisance to those around them.
This includes using the premises for an illegal purpose.
A spokeswoman for the council said: "The Demotion Order, which lasts for 12 months but can be extended, gives a serious warning to the tenant because if they continue to act in an anti-social manner, the council can move more quickly to end their tenancy.
"The order also removes the right to buy the council property and the right to exchange the tenant's property with another tenant."
She added: "As well as a punishment, the orders are intended to be an incentive to tenants to change their behaviour because, if they stop causing problems, they can regain a secure tenancy with all its rights and benefits."
Demotion Orders can be used in cases where there has been anti-social behaviour, but the council does not want to evict the tenant because there is a chance the behaviour may change.
However, the council could also seek an order at the same time as they try to evict the tenant.
This allows magistrates to look at the evidence for eviction and demotion at the same time and decide on the best course of action.
l The council's social affairs and health scrutiny committee will discuss the proposed adoption of Demoted Tenancy Orders when it meets next Tuesday at 9.30am in the town hall.
