Shane Cook has astounded doctors with his amazing will to live after suffering horrific head injuries in a 30ft fall.
Shane, seven, is making a speedy return to health just a month after plunging through the roof of a Territorial Army centre in South Shields.
His parents have started action against the Ministry of Defence, claiming the building was insecure.
The youngster plunged to the concrete floor on October 24.
Doctors warned his parents that he faced a desperate battle to live.
He underwent several life-saving operations at Newcastle General Hospital. where his parents, Peter Cook and Jennifer Frame, kept a vigil,
Mr Cook, 34, said: "The way he has pulled through is nothing short of a miracle.
"Initially, the doctors said things did not look good, but Shane showed an amazing will to live.
"To be honest, I thought we would be having Christmas dinner in hospital, but the way he has picked up has been incredible,"
Shane will have to go back into hospital in January for an operation to mend his shattered skull,
The family has consulted lawyers about taking action against the Ministry of Defence.
Mr Cook said: "I have heard people say that Shane climbed over ten feet of railings to get inside.
"But that is not true. The gates were open and Shane and his friends walked inside."
