THE company behind a scheme to convert a disused cinema into a nightspot has resubmitted its plans to try to avoid a forthcoming public inquiry.
Earlier this year, Tribecka Leisure lodged an appeal against Durham City Council for its failure to determine a planning application for the former Palladium, in Claypath, within the statutory two months.
The appeal is due to be heard by a planning inspector at an inquiry on September 11.
But the applicant has now resubmitted the plans in an attempt to negotiate permission with the city council and avoid the need for an inquiry.
Tribecka wants to convert the art deco cinema into a Chicago Rock Cafe with a bar, eating area and dance floor.
Councillors said they were "minded" to refuse the earlier application because of the impact the development would have on residents of Claypath.
That application is now subject to the appeal and council officers have recommended members of the development control committee reject the current application, which is identical.
Objectors include residents, the City of Durham Trust and the police, who are concerned the development will lead to more disorder on the city's drinking circuit.
The application will be decided by the committee on Wednesday.
