A NURSING home has been granted planning permission to build a second-storey extension to use as a day room.
Darlington Borough Council's planning applications committee was told yesterday that a person living next to Haughton Nursing Home, in Stockton Road, had objected because it would create problems with his garage.
The man said he had a legal right of way over part of the land to access his garage, but would not be able to use it if the extension was built.
The committee heard from planning officers and the borough solicitor that there were no grounds on which the permission could be granted, and the neighbour's concerns would have to be addressed under civil law.
Councillors agreed to approve the extension to the home, although they expressed sympathy for the neighbour's predicament.
