THE Crown Prosecution Service (CPS) is to decide whether to prosecute a North-East nursery over an allegation of neglect.
Police and social services have completed their investigations into The Play Hut, in Darlington.
Detectives have been investigating claims made last month by the parents of a seven-month-old baby and have now submitted files to the CPS.
Graham Dymond, 20, and his fiancee, Donna Ashton, 20, of Gurney Street, Darlington, called the police after they discovered a burn on son Jay's leg when they collected him from the nursery.
A police spokesman said: "The CPS will decide on what action will be taken.
"Specialist officers from the child and family protection unit have interviewed nursery staff and the owner."
The social services department at Darlington Borough Council worked alongside police officers during the investigation.
A council spokesman confirmed that social workers had also submitted material to the CPS.
Education watchdog Ofsted is continuing its investigation into the nursery.
