THE FAMILIES of two men killed when a car collided into a bus shelter where they were waiting have been told the driver will not be prosecuted.
Michael Logan, 28, died saving his seven-year-old stepson's life when the car crashed into the bus stop at East Rainton, near Houghton-le-Spring, Wearside, last September.
Ernie Wilkinson, 54, was also killed after the concrete roof collapsed when the Seat Cordoba hit the shelter.
Mr Logan, from East Rainton, saved the life of his stepson, Craig, by throwing himself over the boy as the concrete came crashing down.
The 26-year-old female driver, who suffered minor injuries and shock, had been interviewed by police and bailed pending further inquiries.
She was driving the Seat which appeared to swerve to avoid children, before mounting a path and crashing into the bus shelter.
Northumbria Police said yesterda that she will not be prosecuted for her part in the tragedy.
A spokeswoman said: "Following police inquiries, a file was passed to the Crown Prosecution Service and a decision was taken that there will be no further action.
"The relatives have been informed and an inquest is to be held in due course."
Mr Logan and his stepson were on their way to a junior football match and stood in the shelter after missing a bus at a stop further along Durham Road.
Mr Wilkinson, a bachelor also from East Rainton, was believed to be bound for a grocery trip to Houghton-le-Spring.
