A RETROSPECTIVE application to allow a former builders' yard in Darlington to be converted to an outdoor recycling area has been refused.
T M Ward Limited, of Faverdale Industrial Estate, had also applied to build a landscaped mound to screen the yard from nearby businesses, allotments and houses close to the Black Path.
The application had taken three years to come before Darlington Borough Council planning committee.
But on Wednesday the committee agreed unanimously that concerns about health issues regarding wind-blown dust and noise meant refusal was the only option.
Councillor David Lyonette said: "I am surprised that the officers have supported this. We have actually discussed enforcement on this at this committee in the past."
Seconding Councillor Gordon Plummer's motion to refuse permission, Coun Lyonette said: "I think it is totally unacceptable and I can't see how it has changed. To grant permission would be an absolute somersault.
