A solicitor with two previous findings of misconduct against him was struck off when he appeared before the Solicitors Disciplinary Tribunal yesterday.
Timothy Nigel Husbands, 38, of Petch's Cottages, Liverton, Saltburn, east Cleveland, admitted borrowing £33,000 from a fund of which he was trustee. He denied dishonesty but was found guilty.
Stephen Battersby, for the Office for the Supervision of Solicitors (OSS), told the London hearing the offence happened in September 1999 at Timothy N V Husbands, of Loftus.
Mr Battersby said that as a trustee Mr Husbands was not entitled to borrow the cash, which has since been repaid.
Mr Husbands admitted allowing his practice to remain open in August 2001 for 18 days while he was suspended for a previous finding of misconduct.
Yesterday, Mr Husbands admitted further offences of providing misleading information to a client, but denied dishonesty regarding trust fund money.
The tribunal ruled he had acted dishonestly.
