A DISCARDED cigarette is believed to have caused a fire which led to the death of a 47-year-old man yesterday.

Frank Bernard Timney was rescued from his burning flat by firefighters in the early hours of the morning but was later pronounced dead at hospital.

Investigators found that while a smoke detector was installed, the batteries had been removed.

Firefighters forced their way into the flat, in Merton Court, Acomb, York, at about 12.20am after neighbours raised the alarm.

Although Mr Timney was given cardiac massage on the way to York District Hospital he was later pronounced dead.

The blaze is thought to have started when the cigarette fell down the side of the settee.

Sub-officer Richard Marlein said: "It is vital that if people do have smoke alarms fitted they check the batteries work.

"It could have saved the man's life or at least given some earlier warning.

"It's also very important to double check that cigarettes are put out properly."
