A DRINKER who kicked a man unconscious during a pub brawl walked free from court yesterday.

Because Omar Ames' victim sent a letter to the judge saying he had started the trouble and did not want his attacker punished, the 25-year-old received a suspended sentence.

Newcastle Crown Court was told how trouble flared when the victim, who was not named in court, started acting rowdily in the Critereon pub, in South Shields, South Tyneside, on December 15.

Witnesses said it was unclear what exactly started the violence, but Ames' victim was left bleeding and bruised after being kicked while on the floor.

Ames, of Sergent Avenue, South Shields, pleaded guilty to affray.

Tony Hawks, defending, said: "He is thoroughly ashamed of his behaviour."

Judge David Hodson said the attack must be marked with a nine-month prison sentenced, but agreed to suspend it for two years.

The judge said: "I entirely accept that you were there for a quiet drink with your brother, minding your own business and there is no doubt this man started it all.

"But whatever was said and whatever he did, no circumstances justify you or anybody else kicking seven bells out of him, because that is effectively what you did."

Judge Hodson said Ames' victim would feel guilty if he went to jail over something he did not start.
