A BARNARD Castle landlord faces having his entertainment licence revoked after allegations that the original terms of the licence have not been met.
Teesdale District Council's licensing committee yesterday called for another hearing into landlord, Andy Power's entertainment licence for The Raby Arms (formerly Folly's) nightclub in the market place.
Peter Fayle, Teesdale council's building control manager, told the committee that no electrical certificate had been provided for the premises and he had not been made aware that conditions relating to fire extinguishers had been implemented.
Mr Power had also been requested to work with the environmental health department to meet sound levels and this had not been done.
Chairman of the committee, Councillor John Armstrong, said he had received a telephone call from a woman who said the noise from the club was dreadful at times.
Councillor Ken Robinson proposed referring the licence issue to another hearing.
He said: "This was approved on the basis that it was subject to certain conditions. Several of these have not been fulfilled and the council has taken every opportunity to try and ensure these conditions were implemented."
Mr Power said he intended to attend the next hearing to put his case
He said: "This has been going on for five years now - it is getting ridiculous. There is no question about the electrical certificate or fire extinguishers, it just comes down to noise. Until the council actually measure how loud it is in the houses nearby, this is never going to get resolved.
