A TAXI driver has been reported to a council for allegedly using a mobile phone while driving an off-duty police officer.
The complainant said David Beaumont, 47, of Starmer Crescent, Darlington, became abusive when challenged.
A letter to Darlington Borough Council's licensing committee said the incident happened on July 22 at 6.35pm when the officer was with his wife.
The officer said he paid the fare of £5.20 for the journey from Darlington Market Square to Gleneagles Road.
He said: "As I received my change I said to the driver 'If I had been on duty I would have pulled you over.
"I am a police officer and am not happy being driven by someone using a mobile phone and it's also against the law."
The policeman claims the driver swore at him and said he did not care because he was off duty.
The officer said: "My complaint is not just that the driver was using his mobile phone but also his attitude to me when I voiced a legitimate complaint.
"I, as a fare-paying passenger, expect to be driven in a safe manner when in any taxi and not to be sworn at when the driver fails to do this."
Mr Beaumont got his first private hire licence in Darlington ten years ago.
A council report said: "Due to the serious nature of the complaint against Mr Beaumont, the committee's direction is sought as to the appropriate action to be taken, if any, with regard to the allegations made by the complainant.
"Mr Beaumont has refused to make comment with regard to the complaint made against him and does not feel that it is a matter that should be referred to this committee."
The committee will make a decision at a later date.
