UK tax laws which stop companies offsetting overseas losses against domestic profits are in breach of EU rules, it was claimed yesterday.
The European Court of Justice in Luxembourg was hearing a landmark case by Marks & Spencer which could force tax regime changes in many European countries.
Lawyers for the multinational retailer argued that differences in tax treatment between domestic and foreign branches of the same company violate EU laws on freedom of establishment
