A Darlington man has been ordered to pay fines and costs totalling £458 for repeatedly dumping waste in a back lane.
Ian Cullen, of Eldon Street, was found guilty at Peterlee Magistrates’ Court under the single justice procedure of breaching a Community Protection Notice (CPN), contrary to Section 48(1), 2(a) and 52 of the Anti-social Behaviour, Crime and Policing Act 2014.
He was fined £220 and ordered to pay costs of £150 and a victim Surcharge of £88.
The court heard that on May 14 this year, Cullen was issued a CPN after loose bags of rubbish from his address were regularly found in the back lane between Eldon Street and Westmoreland Street.
On June 3, civic enforcement officers from Darlington Borough Council were patrolling the area when they found bags of household rubbish in the back lane of Eldon Street.
The bags were again linked to Cullen’s address, showing that he had failed to comply with the CPN.
A Fixed Penalty Notice was issued to Cullen, but when he failed to pay the case was referred to the court and was heard on Wednesday 20 November.
Councillor Jim Garner, Darlington Borough Council’s cabinet member for stronger communities, said: “We would remind residents that all household rubbish should be disposed of properly – either within your general waste wheelie bin or the correct recycling container.
“Once these have been emptied, you should bring them back in as soon as possible, which will help reduce anti-social behaviour, fly tipping and arson in your area.
“Our staff work hard to keep our streets and back lanes clean and fly tipping of any kind will not be tolerated.”
