A DARLINGTON man has been ordered to pay £1,400 in fines and costs after admitting three offences related to fly-tipping.

George Hall, 31, of Hundens Lane, who trades as All Out Rubbish Removals Ltd, pleaded guilty to one offence under section 34 of the Environmental Protection Act 1990 for failing in his duty of care to dispose of controlled waste correctly with regard to a fly-tip at the rear of Borough Road, Darlington.

He also pleaded guilty to two offences under section 110 of the Environment Act 1995 for failing to assist enquiries into fly-tips found at the rear of Greenwell Street, Darlington and Eskdale Place, Newton Aycliffe.

He was fined £800 and ordered to pay £520 costs and a victim surcharge of £80 when he appeared at Peterlee Magistrates’ Court on Tuesday (May 17).

An application by Darlington Borough Council for Hall to be made the subject of a Criminal Behaviour Order was dismissed by the magistrates.

The court heard that on November 10 2020 Civic Enforcement Officers were called to a report of a fly-tip to the rear of Borough Road, Darlington where evidence was recovered.

After a lengthy investigation, interviewing a number of people, Mr Hall’s company, All Out Rubbish Removals, was found to be responsible for the fly-tip.

While this investigation was continuing, two further fly-tips were discovered where evidence linked them to All Out Rubbish Removals Ltd. The first, in March 2021, was to the rear of Greenwell Street, Darlington and the other, in July 2021, was in the play area at Eskdale Place, Newton Aycliffe.

Mr Hall attended an interview in connection to the Greenwell Street incident where he was served documents that required him to provide documentation to assist Darlington Borough Council in its investigation.

Mr Hall failed to provide these and was prosecuted for the offence. Mr Hall also failed to attend an interview with Durham County Council in connection with the Eskdale Place fly-tip and as such was prosecuted for failing to assist with inquiries.

Scott Richardson, ASB & Civic Enforcement Team Leader said: “While we are disappointed that our application for a Criminal Behaviour Order, which would have effectively prevented Mr Hall from operating as a waste carrier, was dismissed Darlington Borough Council will continue to use every available power to tackle those who take payment to dispose of goods correctly and then choose to fly-tip.”

Councillor Jonathan Dulston, Darlington Borough Council’s deputy leader, said: “This case sends out a clear message that fly-tipping will not be tolerated and we continue to work closely with partners to tackle this. Those who fly tip will be caught and you will be prosecuted!”
