A WOMAN has been given a suspended jail term for possessing fake Nike gear with the intention of selling it.

Joanne McKimm of Yorkshire Place, Bishop Auckland, was prosecuted by Durham County Council under the Trade Marks Act 1994 for possessing goods with a false trademark for sale or hire.

She appeared before magistrates in Newton Aycliffe on Thursday, April 21.

McKimm pleaded guilty to possessing trainers which bore a sign identical to, or likely to be mistaken for, the Nike 'Swoosh' registered trademark, with a view to her or another selling the goods.

Magistrates said the offence was so serious it warranted a custodial sentence.

They ordered a 12-week prison sentence suspended for 12-months.

McKimm was also ordered to carry out 12-hours of unpaid work within the next twelve months.

The 44-year-old was also fined £500 and told to pay a £128 victim surcharge, bringing the total she owes the court to £628.
